On October 22, 2021, it was reported that parents from Republic, Missouri, filed a lawsuit against Baby Trend Inc. after their daughter’s wrongful death in a stroller. The lawsuit alleges that the stroller was defectively designed and manufactured, leading to their daughter’s death.

According to the lawsuit, the parents were using the Baby Trend stroller when it suddenly collapsed, causing their daughter to fall out and suffer fatal injuries. The lawsuit further alleges that the stroller’s design was inadequate and that Baby Trend Inc. knew or should have known of the risks associated with the stroller’s design.

Product liability lawsuits are often complex and require a detailed analysis of the facts and circumstances surrounding the product’s design, manufacturing, and marketing. In this case, the parents will need to prove that the stroller was defectively designed or manufactured and that this defect caused their daughter’s death. Similar considerations have to be weighed by product liability attorneys in Houston.

There are three types of defects that can give rise to a product liability claim in Texas:

  • Design defects
  • Manufacturing defects, and
  • Warning defects

design defect exists when the product’s design is inherently dangerous or not safe for its intended use. A manufacturing defect exists when the product’s design is safe, but a flaw in the manufacturing process causes the product to be dangerous. A warning defect exists when the product does not include adequate warnings or instructions for its safe use.

In this case, it appears that the parents are alleging a design defect in the stroller’s collapsible feature. If they can prove that the stroller was defectively designed, they may be able to hold Baby Trend Inc. liable for their daughter’s death.

It is important to note that product liability lawsuits in Texas can take a significant amount of time and resources to pursue. Plaintiffs must have a thorough understanding of the legal process and the evidence required to support their claims. Additionally, manufacturers often have significant resources and legal teams to defend against these types of claims.
